A witness to the incident identified Oschino as the assailant, and Oschino was arrested in November of that year. During the trial the following month, the witness recanted his statement that Oschino was the person who shot Orlando Williams during the altercation. It turns out, the witness mistakenly identified Oschino as the perpetrator because he had recently seen his picture on a CD cover prior to the incident.
